Event Participation Waiver & Release of Liability

A RUNNING LIST Event Terms & Conditions:

1. Acknowledgment & Agreement

By registering for or participating in any event, run, gathering, activation, or activity organized, hosted, or facilitated by A RUNNING LIST (“ARL”), you acknowledge that you have read, understood, and agreed to the terms outlined below. This agreement is legally binding.

2. Assumption of Risk

You understand and acknowledge that participation in running, walking, fitness, wellness, or community-based activities involves inherent risks, including but not limited to:

  • Slips, trips, or falls

  • Collisions with participants, pedestrians, vehicles, or objects

  • Weather conditions (including heat, cold, rain, snow, ice)

  • Road, trail, or environmental hazards

  • Physical exertion and overexertion

  • Equipment malfunction or misuse

  • Illness, injury, permanent disability, or death

You voluntarily assume all risks, known or unknown, foreseeable or unforeseeable, associated with your participation.

3. Release & Waiver of Liability

To the fullest extent permitted by law, you release, waive, and discharge A RUNNING LIST and its founders, directors, officers, employees, contractors, volunteers, sponsors, venue partners, collaborators, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, actions, damages, losses, liabilities, or expenses arising out of or related to your participation in any ARL event.

This release includes, without limitation, claims relating to:

  • Personal injury

  • Illness

  • Permanent disability

  • Death

  • Property damage

  • Theft or loss of personal belongings

You agree that ARL shall not be held liable for any injury, damage, or loss sustained before, during, or after an event.

4. Personal Property

You acknowledge that A RUNNING LIST does not assume responsibility for the safekeeping of personal belongings. ARL shall not be liable for any loss, theft, damage, or destruction of personal property occurring before, during, or after the event, regardless of cause.

All items brought to the event or left in designated bag drop areas are done so at your own risk.

5. Medical Acknowledgment

You confirm that you are physically able to participate in the event and that you assume full responsibility for your health and well-being.

ARL does not provide medical advice, medical services, or on-site medical supervision.

In the event of an emergency, you consent to receive medical treatment deemed necessary and understand that you are solely responsible for any associated medical costs.

6. Personal Responsibility

You agree to follow all event instructions, safety guidance, and applicable laws. You acknowledge that participation is voluntary and that you are solely responsible for assessing your fitness and ability to participate safely.

If at any time you feel unwell, unsafe, or unable to continue, you agree to remove yourself from participation.

7. Photography & Media Release

By participating in any ARL event, you grant A RUNNING LIST the irrevocable, perpetual, worldwide, royalty-free right and license to capture, use, reproduce, publish, distribute, and display your name, image, likeness, voice, and participation in photographs, video recordings, and other media for promotional, marketing, editorial, social media, advertising, and archival purposes, in any format now known or later developed, without compensation.

If you do not consent to media use, you must notify ARL in writing prior to the event.

8. Indemnification

You agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, or expenses (including legal fees) arising from your participation, actions, negligence, or failure to comply with event terms.

9. Third-Party Venues & Public Spaces

You acknowledge that ARL events may take place at third-party venues or in public spaces. ARL is not responsible for the acts, omissions, policies, or conditions of any third-party venue, sponsor, or partner.

10. Multiple Registrations

If you register or purchase tickets on behalf of others, you confirm that each participant has reviewed and agreed to this waiver. You accept responsibility for ensuring that all individuals under your registration comply with these terms.

11. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Ontario, Canada. Any disputes arising from participation in an ARL event shall be resolved in the courts of Ontario.

12. Acknowledgment

By registering for or participating in an ARL event, you acknowledge that:

  • You have read and understood this waiver.

  • You understand you are waiving certain legal rights, including the right to sue.

  • You voluntarily agree to all terms and assume full responsibility for your participation.
